(hereafter “CareEywa”, “we”, or “us”) may process and how we may use that information to better serve visitors and Users while using our website www.CareEywa.com (the ‘Website’) our mobile customer application (the ‘App’) and our services (collectively the “Service”). 1. WHAT INFORMATION DO WE COLLECT

Our Services require us to know who you are to meet your needs best. When you access the Services or through any interaction with us via emails, telephone calls, chats or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to identify you. You hereby consent to the collection of such information by Careeywa. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:

• contact data (such as your email address and phone number);
• demographic data (such as your gender, your date of birth, your baby’s gender, and baby’s date of birth and your pin code);
• data regarding your usage of the services and history of the appointments made by or with you through the use of Services;
• insurance data (such as your insurance carrier and insurance plan);
• other information that you voluntarily choose to provide (such as information you share with us through emails or letters.

The information collected from you by Careeywa may constitute ‘personal information or ‘sensitive personal data or information under the SPI Rules.

“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a corporate body, is capable of identifying such person.

1. DEFINITIONS

Users

All the information provided to Careeywa by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You understand that Careeywa may use certain information of yours, which has been designated as Personal Information or ‘Sensitive Personal Data or Information’ under the SPI Rules, (a) to provide you with the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates (d) for communication purpose to provide You with a better way of booking appointments and for obtaining feedback about the Practitioners and their practice, (e) debugging customer support related issues. (f) to contact you to complete any transaction if you do not complete a transaction after providing us with your contact information in the course of completing such steps designed for the completion of the transaction. Careeywa also reserves the right to use the information provided by or about the User for the following purposes:

• • If you have voluntarily provided your Personal Information to Careeywa for any of the purposes stated above, you hereby consent to such collection and use of such information by Careeywa.
  • Collection, use and disclosure of information designated as Personal Information or Sensitive Personal Data or Information’ under the SPI Rules require your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such use, collection and disclosure as required under applicable law.
  • Careeywa does not control or endorse the content, messages or information found in any Services and, therefore, Careeywa specifically disclaims any liability about the Services and any actions resulting from your participation in any Services. You agree that you waive any claims against Careeywa relating to the same. To the extent such waiver may be ineffective, you agree to release any claims against Careeywa relating to the same.
  • You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by contacting us. We will make reasonable faith efforts to make requested changes in our then-active databases as soon as reasonably practicable. Suppose you provide any information that is untrue, inaccurate, out of date, or incomplete (or becomes false, inaccurate, out of date or incomplete), or Careeywa has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete. In that case, Careeywa may, at its sole discretion, discontinue the provision of the Services to you. There may be circumstances where Careeywa will not correct, delete or update your Personal Data, including (a) where the Personal Data is opinion data that is kept solely for an evaluative purpose; and (b) the Personal Data is in documents related to a prosecution if all proceedings relating to the prosecution have not been completed.
  • If you wish to cancel your account or request that we no longer use your information to provide you with Services, you can do that directly from the website or may contact us via our contact us details. We will retain your information for as long as your account with the Services is active and as needed to provide you with the Services. We shall not retain such information for longer than required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After some time, your data may be anonymized and aggregated and then maybe held by us as long as necessary for us to provide our Services effectively. Still, our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent or cancellation of account may result in Careeywa being unable to provide you with its Services or to terminate any existing relationship Careeywa may have with you.
  • If you wish to opt out of receiving non-essential communications such as promotional and marketing-related information regarding the Services, please send us an email at [email protected].
  • Careeywa may require the User to pay with a credit card, wire transfer, debit card or cheque for Services for which subscription amount(s) is/are payable. Careeywa will collect such User’s a credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the User through the authentication process. Users’ credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. However, Careeywa provides you with an option not to save your payment details. The user is advised, however, that internet technology is not foolproof safe and the User should exercise discretion on using the same.
  • Due to the communications standards on the Internet, when a User or anyone visits the Website, Careeywa automatically receives the URL of the site from which anyone visits. Careeywa also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), the User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyze overall trends to help Careeywa improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with or disclosed to third parties. Notwithstanding the above, Careeywa may share and/or disclose some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others to help grow its business. Careeywa may use social media to collect your details via any promotional or educational campaigns
  • The Website uses temporary cookies to store certain (that is not sensitive personal data or information) that are used by Careeywa and its service providers for the technical administration of the Website, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, Careeywa may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies, however, do not store any Personal Information of the User. You may adjust your Internet browser to disable cookies. If cookies are disabled you may still use the Website, but the Website may be limited in the use of some of the features.
  • A User may have limited access to the Website without creating an account on the Website. Unregistered Users can make appointments with the doctors by providing their names and phone number. To have access to all the features and benefits on our Website, a User must first create an account on our Website. To create an account, a User is required to provide the following information, which such User recognizes and expressly acknowledges is Personal Information allowing others, including Careeywa, to identify the User: name, User ID, email address, country, ZIP/postal code, age, phone number, password chosen by the User and valid financial account information. Other information requested on the registration page, including the ability to receive promotional offers from Careeywa, is optional. Careeywa may, in the future, include other optional requests for information from the User to help Careeywa to customize the Website to deliver personalized information to the User.
  • This Privacy Policy applies to Services that are owned and operated by Careeywa. Careeywa does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their cookies or other files on the User’s computer, collect data or solicit personal information from the Users, for which Careeywa is not responsible or liable. Accordingly, Careeywa does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Careeywa guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites.   • Careeywa does not collect information about the visitors of the Website from other sources, such as public records or bodies, or private organizations, save and except for registration of the Users (the collection, use, storage and disclosure of which each End User must agree to under the Terms of Use for Careeywa to effectively render the Services).
  • Careeywa maintains a strict “No-Spam” policy, which means that Careeywa does not intend to sell, rent or otherwise give your e-mail address to a third party without your consent.
  • Careeywa has implemented best international market practices and security policies, rules and technical measures to protect the personal data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, Careeywa shall not be held liable for any loss whatsoever incurred by the User.
  • Careeywa implements reasonable security practices and procedures and has a comprehensively documented information security program and information security policies that contain managerial, technical, operational and physical security control measures that are commensurate concerning the information being collected and the nature of Careeywa’s business.
  • Careeywa takes your right to privacy very seriously and other than as specifically stated in this Privacy Policy will only disclose your Personal Information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when Careeywa, in its sole discretion, deems it necessary to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.

FOR WHAT PURPOSES DO WE PROCESS YOUR DATA?

3.1 TECHNICAL AND FUNCTIONAL MANAGEMENT OF THE WEBSITE AND APP

When you visit our Website, our website administrators process technical data such as your IP address, visited webpages, the internet browser you use, your previous/next visited websites and the duration of a visit/session to enable us to deliver the functionalities of the Website. In addition, in certain instances, the browser or application may prompt you for your geo-location to allow us to provide you with an enhanced experience. With this technical data, our website administrators can manage the Website, for instance by resolving technical difficulties or improving the accessibility of certain parts of the Website. This way, we ensure that you can (continue to) find the information on the Website quickly and simply.

When you use our App, we also process technical data such as your IP address, Device ID or MAC address, and information about the manufacturer, model, and operating system of your mobile device. We use this data to enable us to deliver the functionalities of the App, resolve technical difficulties, and provide you with the correct and most up-to-date version of the App and to improve the function of the App.

3.2 CUSTOMER SERVICE

When you register as a User, we will collect your name, email address, country, language, password, mobile phone number, gender, IP address, MAC-address, and credit card number, expiry date and security code.

We will use your contact details to send you a welcoming email/sms to verify your username and password, to communicate with you in response to your inquiries, and to send you service-related announcements, for instance, if our Service is temporarily suspended for maintenance. We will use your registration information to create and manage your CareEywa account. We may deactivate your account if we suspect that you use our App to commit fraudulent or illegal acts or if you violate our terms of use.

3.3 ENHANCING YOUR CareEywa EXPERIENCE

PERSONAL INFORMATION

When you request medicines via your use of the App, we provide your first name or last name, delivery address and your phone number to the Partner so that they can contact you to confirm your requirements.

PHOTO

If you choose to upload a photo to your CareEywa account, your photo will be viewable by the Partners who are providing you with the service/product. You may remove or replace your photo at any time by logging into your account on the mobile application.

TELEPHONE NUMBER AND PUSH NOTIFICATIONS

If you have requested services through the Website or the App, from the time that your request is accepted by the Partner, until you get your services, you and the Partner will have the ability to contact each other, via the mobile phone used to request the services. During that time and only if you have consented we will send you to push notifications to your mobile phone to let you know your order status. To send you to push notifications we will process your telephone number. If you do not want to receive push notifications you can always withdraw your consent by changing your settings via the settings page of your mobile telephone.

3.4 PROCESSING PAYMENTS

When you register as a User, you can opt for cash on delivery or an online method such as a wallet or credit card/debit card. You allow CareEywa to charge your online wallet or credit card/debit card.

3.5 MARKETING

CareEywa may use your contact details to send you general updates regarding CareEywa news, special offers and promotions. You may at all times opt-out of receiving these updates.

3.6 GENERATING MANAGEMENT INFORMATION AND STATISTICAL DATA

CareEywa uses your data in an anonymised and aggregated form to closely monitor which features of the Service are used most, to analyse usage patterns and to determine where we should offer or focus our Service. We may share this information with third parties for industry analysis and statistics.

3.7 ADMINISTRATING JOB APPLICATIONS

If you wish to apply for a job on our Website we will collect personal information such as your name, email address, and phone number and additional information such as your resume and gender. We use the information collected within this area of the Website to register and process your application, to determine your qualifications for the position for which you have applied and to contact you.

3.8 Invite-A-FRIEND

If you choose to use our referral feature in the App to tell a friend about our Service, you will be prompted to enter your friend’s email address or mobile phone number or log into your preferred social network. If you elect to refer a friend, we will automatically populate a message for you to send to your friend inviting him or her to try the Service on your behalf, however, the actual message will be sent via your mobile device or social network and you will be able to edit the final message before you send it. We do not store your friend’s data.

3.9 ADMINISTRATING PUBLIC FORUMS

The Website and the App may offer publicly accessible blogs and community forums. We will use your data such as your name, email address, and the messages or content you choose to post to administrate and provide you with these services. You should be aware that any information you provide in these areas might be read, collected, and used by others who access them. To request the removal of your personal information from our blog or community forum, please contact us at [email protected].

4. OUR DISCLOSURE OF YOUR INFORMATION

We may employ third-party companies and individuals to facilitate or provide the Service on our behalf, to process payment, provide customer support, provide geo-location information to our Pharmacy, host our job application form, perform Website-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Website’s features) or to assist us in analysing how our Service is used. These third parties have access to your personal information only to perform these tasks on our behalf and are contractually bound not to disclose or use it for any other purpose.

CareEywa will disclose your data to the extent that this is legally required, or necessary for the establishment, exercise or defence of legal claims and legal process; or in the event of an emergency about your health and/or safety.

5. YOUR RIGHTS

As a user, you have the right to information regarding your account, including information that you’ve provided to us and information regarding each medicine requested via the App. You may at any time request correction or erasure of your data, and object to any processing of your data by emailing us at [email protected]. We will respond to your access and/or correction request within four weeks. You may also amend your details and withdraw any given consent using your CareEywa account.

6. RETENTION

Unless specified otherwise in this Privacy and Cookie Policy, we will retain your information until you cancel your CareEywa account, or until your CareEywa account has been inactive for a year. If you wish to cancel your CareEywa account or request that we no longer use your information to provide you with services, please contact us at [email protected]. Upon the expiry of the one year of inactivity, we will alert you and give you two weeks to re-activate your CareEywa account or retrieve any personal information you want to keep. After the deletion of your account, we will anonymise your data unless these data are necessary to comply with a legal obligation or resolve disputes.

7. SECURITY

CareEywa has taken appropriate technical and organisational security measures against the loss or unlawful processing of your data. To this purpose, your data are securely stored within our database, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers).

However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you supply won’t be intercepted while being transmitted to us over the Internet. Any transmission of information by you to CareEywa is at your own risk. We recommend that you do not disclose your password to anyone.

• Your Personal Information is maintained by Careeywa in electronic form on its equipment, and on the equipment of its employees. Such information may also be converted to physical form from time to time. Careeywa takes all necessary precautions to protect your personal information both online and offline and implements reasonable security practices and measures including certain managerial, technical, operational and physical security control measures that are commensurate concerning the information being collected and the nature of Careeywa’s business.
• No administrator at Careeywa will know your password. You need to protect against unauthorized access to your password, your computer and your mobile phone. Be sure to log off from the Website when finished. Careeywa does not undertake any liability for any unauthorized use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify Careeywa by sending an email to [email protected] You shall be liable to indemnify Careeywa due to any loss suffered by it due to such unauthorized use of your account and password.
• Careeywa makes all User information accessible to its employees, agents or partners and third parties only on a need-to-know basis and binds only its employees to strict confidentiality obligations.
• Part of the functionality of Careeywa is assisting the patients to access information relating to them. Careeywa may, therefore, retain and submit all such records to the relevant patients, or their doctors.
• Notwithstanding the above, Careeywa is not responsible for the confidentiality, security or distribution of your Personal Information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, Careeywa shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of Careeywa including but not limited to, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.

8. COOKIE POLICY

The Website uses “cookies”. A cookie is a small text file that we place on your computer or mobile device to enable various features of the Website. You can change your cookie settings to accept or not accept cookies in your browser settings.

9. CHANGES IN THIS PRIVACY POLICY

• Careeywa may update this Privacy Policy at any time, with or without advance notice. In the event, there are significant changes in the way Careeywa treats User’s personally identifiable information, or in the Privacy Policy itself, Careeywa will display a notice on the Website or send Users an email, as provided above, so that you may review the changed terms before continuing to use the Services. As always, if you object to any of the changes to our terms, and you no longer wish to use the Services, you may deactivate your account. Unless stated otherwise, Careeywa’s current Privacy Policy applies to all information that Careeywa has about you and your account.
• If a User uses the Services or accesses the Website after a notice of changes has been sent to such User or published on the Website, such User hereby provides his/her/its consent to the changed terms.

10. RETURN & CONSENT

• You acknowledge that this Privacy Policy is a part of the Terms of Use of the Website and the other Services. You unconditionally agree that becoming a User of the Website and its Services signifies your (i) assent to this Privacy Policy and (ii) consent to Careeywa using, collecting, processing and/or disclosing your Personal Information in the manner and for the purposes set out in this Privacy Policy. • You also acknowledge that information provided by careeywa using their website or any social media platform should not be considered as treatment or medical advice. • Please note that (i) does not recommend or endorse any practitioners mentioned on the Website; (ii) does not make any representations or warranties concerning practitioners or the quality of the healthcare services they may provide; and (iii) does not grade practitioners.
